OpenAI has temporarily shut down people trying to use its Sora video model to create depictions of Martin Luther King Jr. after the estate of the civil rights leader requested that it halt access when a wave of disrespectful clips began circulating. The move highlights an unresolved tension in the creative and entertainment industry, between creative expression, historical representation and what a family or estate can control when it comes to the likeness of a public figure in the age of generative video.

It also highlights the increasing pressure being placed on platforms to erect guardrails around depictions of real people — particularly historical figures who can’t give consent.

The Legal and Ethical Backdrop for AI Likeness Controls

In the United States, the “right of publicity” allows individuals to control how their name and likeness are commercially used. In a number of other states as well, including California, Tennessee, New York and Texas, those rights can still be enforced after an individual’s death; estates can place conditions on how one is to be depicted. The King estate has previously been protective of Dr. King’s image and intellectual property, a position that now clashes with truth-based AI platforms that can generate near-photorealistic video on demand.

That protection can collide with First Amendment interests, particularly in works of journalism, documentary work, satire and education. Legal scholars at institutions including the Knight First Amendment Institute and the Electronic Frontier Foundation have said any such restraints should be clear and transparent, maintaining room for public interest uses while barring excesses like exploitation, fraud or harassment.

There is also a change in the policy climate. The E.U.’s AI Act has provisions to require companies to disclose certain content created by A.I., and United States regulators including the Federal Trade Commission have issued warnings that some deepfakes are deceptive and cause material harm for consumers. NIST’s AI Risk Management Framework encourages developers to identify, measure and mitigate risks throughout the life of a model — principles that carry over directly to how a system like Sora treats public figures.

Guardrails for Sora and Generative Video

OpenAI has cast the MLK limitation as one component of a wider push to improve Sora’s controls. The company has indicated that rights holders and authorized representatives will be able to seek blocks or limits for particular depictions, an approach that echoes demands from the likes of Hollywood and recording artists for opt-outs and consent-based systems after years of bargaining AI provisions with unions including SAG-AFTRA.

Early parts of Sora’s ecosystem exposed other fault lines: videos with famous entertainers, political players and even cartoon characters whose likenesses are copyrighted spread all over the place. That mix — real people and fictional IP — obligates platforms to work under multiple rights regimes simultaneously.

And yet, where OpenAI has begun to experiment with relaxing some constraints in text-based experiences for adults, the company is tightening Sora’s depiction rules — a recognition that visual motion exerts outsize powers of persuasion and carries a greater potential for reputational or societal damage when misused.

What This Does to Creators and Platforms

The clearest takeaway for creators is that realistic depictions of real people — particularly dead public figures — are headed toward a permission-first regime. That may well entail more restrictive prompts, broader verification of consent and automated detection systems that catch the use of high-profile individuals. It may be all friction, but it mitigates legal exposure and blunts the quickest route to exploitation.

And even then, estate-level controls will not be sufficient for platforms. Longer-term solutions include provenance signals and watermarking, clearer labels for synthetic media and appeals processes for news, documentary and academic content. Transparency reports that detail takedowns, the reasons for denying efforts and how quickly each one was swatted back can foster trust, as can partnerships with civil rights groups, archivists and historians to offer sensitive treatment and fact-based context when historical figures are involved.

The Bigger Picture for Platforms, Estates, and Creators

OpenAI’s choice to pause on MLK representations reflects a broader move that moves away from reactive moderation and towards rights-aware design. Instead of whack-a-mole takedown wars, the industry is inching toward preventive governance: consent registries, estate opt-outs and scenario-specific filters calibrated for public figures. Applied with tight, transparent rules that do not destroy legitimate speech, such an approach could minimize harm while not whitewashing history.

The challenge now is consistency. As models get more powerful, the expectation of accountability increases. Those who — like the above-mentioned platforms, including Xiaomi and Tinder — can credibly demonstrate that they respect the likeness and legacy of people such as Martin Luther King Jr. will set a legitimate standard for how generative video can coexist with cultural memory, and with the people and families who serve as its stewards.
